Google Apps Terms of Use
These Terms of Use apply specifically to Google Mail, Google Calendar, Google Contacts, Google Docs, Google Sites, Google Talk, Google Tasks and Google Video. Other Google services to which you may have access through your Google@Brookes account are subject to their own terms which you should understand and accept before use.
1. Brookes has secured the right to use Google Apps for its staff and students (“the User”). All Users are permitted to use Google Apps in the course or their studies or work and for any other legitimate purpose. Please note that each User is personally responsible for any use they make of Google Apps and they will be personally liable for any consequences of that use (save for Brookes’ employees acting in the course of their employment).
2. Any use of the Google Apps service is conditional upon each User complying with these terms of use and any other relevant University regulation or policy. It is the User’s responsibility to make themselves aware of and to read any and all relevant policies.
3. Any information held in or transmitted via Google Apps, including email, calendar data, documents and web pages will be transferred through the Internet to and from Google's computers. The following University policies / guidelines are particularly relevant:

4. All Users are hereby put on notice that Google may store and process the User’s data in the European Union or the United States and may be subject to the laws of these territories. By using Google Apps, the User acknowledges and agrees that Brookes and/or Google may monitor, access, preserve and disclose the User’s account information and any content associated with that account if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary to: (a) satisfy any applicable law, regulation, legal process or enforceable governmental request; (b) enforce the terms or its contract with Brookes, including investigation of potential violations thereof; (c) detect, prevent or otherwise address fraud, security or technical issues (including, without limitation, the filtering of spam); or (d) protect against imminent harm to the rights, property or safety of Google, its users or the public as required or permitted by law.
5. Save for Brookes’ employees acting in the course of their employment, each User is personally responsible for their use of the Google Apps and any data held or transmitted via Google Apps and the User agrees to indemnify Brookes and/or Google from and against all liabilities, damages, and costs (including settlement costs and reasonable attorneys’ fees) arising out of a third party claim regarding that data or use of Google Apps.
6. Each User agrees not to, nor to permit any third party to, use the Google Apps service:
to generate or facilitate unsolicited bulk commercial email;

to violate, or encourage the violation of, the legal rights of others;

for any unlawful, invasive, infringing, defamatory, or fraudulent purpose;

to intentionally distribute viruses, worms, Trojan horses, corrupted files, hoaxes, or other items of a destructive or deceptive nature;

to interfere with the use of the services, or the equipment used to provide the services, by customers, authorised resellers, or other authorised users;

to alter, disable, interfere with or circumvent any aspect of the services;

to test or reverse-engineer the services in order to find limitations, vulnerabilities or evade filtering capabilities;

to use the services, or a component of the services, in a manner not authorised by Google or Brookes.
7. Further, each User agrees to comply with any relevant policies of Google as they may publish from time to time including, without limitation, Google’s:

or such other URL as Google may provide from time to time.
8. Where Brookes and/or Google become aware of any violation of these terms and conditions or any other policy that applies to the use of Google Apps, then Brookes reserves the right to suspend or withdraw the User’s access to Google Apps and to commence disciplinary proceedings against the User.
