Future adoption leave

Staff who qualify for adoption leave for their second, third, fourth etc adoption, may not necessarily qualify for statutory adoption pay and occupational adoption pay. To qualify for statutory adoption pay and occupational adoption pay for eight weeks prior to the end of the qualifying week, which is the end of the week in which the member of staff is notified as being matched with a child for adoption, the member of staff must have been earning on average not less than the lower earnings limit for national insurance purposes.

Benefits you may be entitled to

There are a number of different benefits that staff may be entitled to and they should contact the Benefits Agency to find out, such as: Children’s Tax Credit, Income Support and Incapacity Benefit.

Union

When paid adoption leave finishes, Union contributions will also cease. The member of staff must contact their union should they wish their contributions to continue.

Sick pay whilst on adoption leave or if returned early from adoption leave

The normal sickness leave rules apply unless adoption leave has commenced. Staff are not entitled to sick leave whilst receiving statutory adoption pay or unpaid leave. If a member of staff resumes work before the end of their 39 week entitlement to statutory adoption pay whilst on sick leave they will revert to receiving statutory adoption pay.

Staff with more than one employer

Statutory adoption pay applies to each employment contract, therefore, a member of staff who has two employers will receive statutory adoption pay from each employer provided they meet the criteria for each employer - see Adoption pay.
