Introduction

Under the Immigration, Asylum and Nationality Act 2006 the university is liable for a civil penalty of up to £20,000 per case of knowingly employing someone who has no permission to work in the UK.  As such there are various checks that must be carried out which start at interview stage

The Act states that all individuals wishing to work in the UK must be entitled to do so before they can be employed, and must be able to prove their right to work.  All recruiting Managers are responsible to obtain this proof at interview stage (usually a photocopy of passport).  See prevention of illegal working document list (Word doc) for more details. Recruiting Managers are also asked to fill in the “Eligibility Checklist” form.

 

Please note that if you are employing an international [non-EU] student then you must check to see if they have any other contracts of employment at all with the University, perhaps in a different Directorate or Faculty. This is because no more than 20 hours per week can be worked by any international student during semester time and this includes any combination of hourly-paid contract. Recruiting managers have a responsibility for checking this.
